IC2-327: Workers' Compensation Payment on Medical-Only Claims or Indemnity Payments
Due annually: March 3 (Jan-Dec payments).

Due semi-annually: July 31 (Jan-Jun payments), March 3 (Jul-Dec payments).

Out-of-State Check Waivers

To apply for an Out-of-State Check-Writing Waiver, submit a completed application and affidavit to the Industrial Commission at PO Box 83720, Boise, ID 83720-0041. Each surety/underwriter must apply for its own waiver. Waivers are not issued to insurance groups, or to third party adjusters.


Upon receipt of the application, we will review and determine whether we will issue the waiver, based upon the information you return to us and independent information available to us regarding your claims management practices.

 

Medical Fee Disputes

Disputed fees for workers' compensation medical services may be appealed to the Industrial Commission. We have created a guide with frequently asked questions on the medical fee dispute procedure.

Injury Reporting

If a work-related injury or illness results in lost work time or requires medical treatment, that injury or illness must be reported to the Idaho Industrial Commission. This is done with a First Report of Injury or Illness form.

Audit schedule

The Industrial Commission conducts regular compliance audits of insurers and their designated in-state adjusters. The calendar is available to the public. In addition, the Commission solicits public comments in advance of Commission audits.

 
Rehabilitation services

The Industrial Commission offers rehabilitation services to Idaho workers injured on the job. We have rehabilitation staff in our ten field offices and our Boise location. Rehabilitation professionals can help workers get back to work after a disabling injury or illness.

 
 Self-insurance

Employers may self-insure under specific conditions. You can download a self-insurance application form as well as supplemental application. The basic requirements are included in the Administrative Rules of the Idaho Industrial Commission. Go to section .014 "Rules Governing Self-Insured Employers" for full details. Self-insuring employers must also conform with the other requirements of a workers' compensation insurer.

 

 EDI

The Idaho Industrial Commission has established Electronic Data Interchange (EDI) partnerships for first-report of injury data. Please contact Mary Stump (208-334-6039) or Scott McDougall (208-334-6063) for further information.

 

 Proof-of-Coverage

Idaho is a partner with the National Council on Compensation Insurance, Inc. (NCCI) for proof-of-coverage data. Reporting to NCCI is mandatory for insurers licensed in Idaho. The Commission's policy reporting requirements are available on-line.
