The Idaho Public Records Law (Idaho Code Sections
9-337 through 9-350) grants every person the right to examine and take a
copy of the public records of the Idaho Industrial Commission. However,
Idaho Code Section
9-340B exempts workers’ compensation records from disclosure, except in
certain circumstances. Records Management Request (RMR) forms are used to
request information which may be disclosed, and are available for
downloading from the web site. The RMR forms are explained below. Our

- Request for
Workers' Compensation Records (RMR-1)
- This form is used by
PARTIES to an OPEN or CLOSED Idaho workers’ compensation claim. A Party
is:
- The Injured Employee
- The Employer
- The Surety (Insurance
Company for the Employer)
- The Idaho Special
Indemnity Fund
- The Attorney
representing one of the above parties.
Note: This form may be faxed to the Commission.

- Employer
Certificate and Request for Work History (RMR-2)
- This form is used by
Employers and Prospective Employers that ARE subject to the
American with Disabilities Act (ADA) Regulations.
- Note: This form requires
an original with the Notary Public Seal.

Release Work History (RMR-3)
- This form is used by
Employers and Perspective Employers that are NOT subject to the
ADA Regulations.
- Note: This form requires
the Employees Signature to release the information.

- Claimant's Request
for Personal Workers' Compensation Records (RMR-4)
- This form is the
Employee’s Release form to permit other "Non-Parties" to get
information.
- Note: Examples of who
should use this form are:
- 1. An Attorney who is
not representing the claimant in an Idaho workers’ compensation claim.
- 2. An Employee that
wants the information sent to a government agency such as the Social
Security Administration.
- Workers’ compensation
agencies from other states than Idaho.

Other public records requests not related to individual claims

- Print Clearly or Type the
requested information.
- Fill in all the
information requested the best you can. If a question has an asterisk *,
it must be filled in or the request will be rejected and returned for the
mandatory information.
- Use the claimants’ LEGAL
name and AKA’s if there are claims under other names used.
